Southold Town is applying different definitions of farming to farmers depending on their political affiliations. The application of Shinn Vinyards to erect a windmill was responded to with the attitude, You have to follow the existing law, like everybody else. But the application of Pindar Vineyard was responded to with the attitude, we would be happy to change the law for you.
The Christmas store of Edson is being encouraged to operate as a farmstand, but the tasting patio of Sherwood Vinyards is being treated as if it were pouring poison.
Then there is Satur Farms. If you could land a Concorde turbojet-powered supersonic passenger airliner on a farm would that make it a farm vehicle? Of course not, but that is tantamount to the position apparently being adopted by the Suffolk County District Attorney's Office. I have driven tractors on farms, and I have driven forklifts in factories. From personal experience I assure you, forklifts are not farm vehicles.
Southold Town has looked the other way and has taken enforcement actions against Satur Farms. Such inconsistent approaches are self defeating.
In New Zealand, the diffecrence between farm vehicles and forklifts is recognized, see http://www.nzta.govt.nz/vehicle/your/agriculture-forklifts.html
